TO:                 BC/FAU FACULTY
FROM:            Leon Williams, Library Assistant II
                       Circulation/Reserve Department

SUBJECT:    THE COPYRIGHT LAW AS IT PERTAINS TO RESERVE MATERIALS

Faculty members may place books from the circulating collection and other materials (including personal copies) on reserve. While every effort will be made to protect personal material, the library cannot be responsible for lost or damaged materials. All materials placed on reserve must comply with the Copyright Law. In an effort to help us abide by the Copyright Law, we are asking each of you who are placing materials on reserve, especially photocopies, to adhere to the law.

THE COPYRIGHT LAW

In compliance with Copyright Law, faculty members may reproduce one (1) copy of work NOT his or her own to be placed on reserve. To reproduce multiple copies of the same work is a violation of the Copyright Law. A faculty member is allowed to reproduce up to five (5) copies only with a permission letter. If a permission letter is not in hand at the time the faculty member wishes to place the multiple copies on reserve then she/he must show proof that a permission letter is already in process. Permission is not needed for solutions to problems of an unpublished nature, the instructor's own articles, and federal or state laws or cases.

          NOTICE: WARNING CONCERNING COPYRIGHT RESTRICTIONS

THE COPYRIGHT LAW OF UNITED STATES (TITLE 17, UNITED STATES CODE) GOVERNS THE MAKING OF PHOTOCOPIES OR OTHER REPRODUCTIONS OF COPYRIGHT MATERIAL UNDER CERTAIN CONDITIONS SPECIFIED IN THE LAW. LIBRARIES AND ARCHIVES ARE AUTHORIZED TO FURNISH A PHOTOCOPY OR OTHER REPRODUCTION. ONE OF THESE SPECIFIED CONDITIONS IS THAT THE PHOTOCOPY OR REPRODUCTION IS NOT TO BE "USED FOR ANY PURPOSE OTHER THAN PRIVATE STUDY, SCHOLARSHIP, OR RESEARCH." IF A USER MAKES A REQUEST FOR, OR LATER USES, A PHOTOCOPY OR REPRODUCTION FOR PURPOSES IN EXCESS OF "FAIR USE", THAT USER MAY BE LIABLE FOR COPYRIGHT INFRINGEMENT. THIS INSTITUTION RESERVES THE RIGHT TO REFUSE TO ACCEPT A COPYING ORDER IF, IN ITS JUDGMENT FULFILLMENT OF THE ORDER WOULD INVOLVE VIOLATION OF COPYRIGHT LAW.
