ANTITRUST ACTS / LAWS / POLICY

 

DEFINITION: “Federal and state statutes to protect trade and commerce from unlawful restraints, price discrimination, price fixing, and monopolies.” Most states have mini-antitrust acts patterned on the federal acts. The principal federal antitrust acts are: Sherman Act (1890); Clayton Act (1914); Federal Trade Commission Act (1914); Robinson-Patman Act (1936). (Black's Law Dictionary, Sixth Ed.)

 

NARROW THE TOPIC:

·         Why do we need antitrust laws?

·         Have antitrust laws been good or bad for the U.S. economy?

·         Who regulates the antitrust laws? Can a private citizen enforce the antitrust law?

·         Compare and contrast the State of Florida Antitrust laws with the other states in the United States.

·         Select a specific industry such as banking or technology or telecommunication and discuss the wave of mergers in that industry; are such mergers good or bad for consumers?

·         Should the federal government and the states have filed antitrust suits against Microsoft?

·         Discuss the Microsoft antitrust case and its ramifications.

·         Would the outcome of the Microsoft case set the tone for future innovations in the technology industry or place a new focus on the importance of enforcement of antitrust laws?
